Terms of Service
These Terms of Service ("Terms") govern your access to and use of GrowthTracker ("Service"), operated by GrowthTracker ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. The Service
GrowthTracker is a cloud-based CRM platform designed to help local businesses track leads, manage follow-ups, and measure sales performance. Access is provided via subscription on a monthly basis.
2. Accounts
You must provide accurate information when creating your account. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at support@growthtracker.fyi if you suspect unauthorized access.
3. Free Trial
We offer a 7-day free trial. No charges occur during the trial period. If you do not cancel before the trial ends, your selected plan will begin automatically and your payment method will be charged. You may cancel at any time before day 7 to avoid being billed.
4. Subscriptions and Billing
Subscriptions are billed monthly. Payment is due at the start of each billing cycle. We use third-party payment processors and do not store your full card details. Fees are non-refundable except as described in our Billing Policy.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Transmit spam or unsolicited communications
- Upload malicious code or attempt to breach security
- Resell or sublicense the Service without written permission
- Impersonate any person or entity

6. Your Data
You own your data. We store it to provide the Service and do not sell it. You may export or delete your data at any time. See our Privacy Policy and Data Processing Agreement for details.
7. Availability
We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance with or without notice. We are not liable for losses resulting from downtime.
8. Termination
You may cancel your account at any time by emailing support@growthtracker.fyi. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 30 days then deleted.
9. Limitation of Liability
To the maximum extent permitted by law, GrowthTracker is not liable for indirect, incidental, or consequential damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will meet your specific requirements or be error-free.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes via email.
